ABSTRACT
The case of Bajaj Auto Ltd. V. TVS Motor Company Ltd. is an important decision of the Hon’ble Supreme Court of India concerning patent Infringement and the grant of interim injunctions. The dispute arose when Bajaj Auto claimed that a new motorcycle from TVS Motor Company used technology that belonged to a patent held by Bajaj Auto for a combustion engine. This case brought up tough questions about patent infringement, if a patent is actually valid, what counts as prior art and the rules for giving out interim relief during intellectual property disputes. This judgment is important because it looks at how to balance the rights of a patent holder with the need to let a competing business keep working while the main legal dispute is still going on. This case analysis will look at the facts, the issues on which both sides argued the court decisions and the legal principles the Supreme Court used to settle the dispute.
