ABSTRACT Marico Limited v. Agro Tech Food Limited plays a crucial role in Trademark Law. It highlights that the Trademark Law protects identity of products rather than descriptive expression. The dispute arose when Agro Tech used the expression LOW ABSORB on their product packaging. Marico claimed that the expression “low absorb” is similar to their registered mark and Agro Tech is amounting to infringement. The court examined the LOW ABSORB describing the product characteristics so the defendant is not liable for infringement. Also, the court clarifies the difference between descriptive and distinctive marks and provides scope on marks under the Trademark Law.
